There is no legal requirement to leave a will, but there are a number of practical and financial reasons as to why you should do so. If you fail to leave a will in Scotland, your estate will be distributed in accordance with the rules of intestacy.

If you pass away ‘intestate’ (without a will) you will have no say over how your estate is distributed. This means that even if you intended or told someone they could have part of your estate, there is no guarantee this will be upheld.
